UK FCA Publishes Crypto Authorization Guidance Ahead of September Applications

UK FCA sets crypto authorization steering ahead of September application window

The UK Financial Conduct Authority has issued final guidance to help crypto businesses determine whether they will need authorization under the country’s incoming digital asset regulatory regime.

The guidance covers activities including the issuance of qualifying stablecoins, operating cryptoasset trading platforms, dealing and arranging transactions, safeguarding cryptoassets and arranging crypto staking. It is intended to clarify which activities fall within the FCA’s regulatory perimeter and what permissions businesses may need.

Applications to open on September 30

The FCA will begin accepting applications on September 30. Firms seeking transitional arrangements must apply by February 28, 2027, ahead of the new regime taking effect on October 25, 2027.

Existing registrations and permissions will not automatically transfer into the new framework. Companies must therefore assess whether they need to seek FCA authorization or apply to vary their existing permissions.

“Preparing for regulation begins with understanding how the regime applies to your business,” said David Geale, the FCA’s executive director of consumers, payments and competition. He added that the guidance was designed to give businesses the clarity needed to prepare with confidence.

UK expands its digital asset framework

The guidance comes as the UK works to bring a wider range of cryptoasset activities under formal financial regulation. Parliament approved legislation in February bringing cryptoassets within the FCA’s regulatory remit, and the regulator finalized a package of rules and guidance in June.

The House of Lords last week voted 194–138 in favor of an amendment to the Financial Services and Markets Bill. The amendment would require the Treasury to produce a digital asset strategy covering cryptoassets, stablecoins, tokenized securities and digital financial infrastructure within 12 months of the bill becoming law.

The FCA is also examining tokenized assets. It recently sought views on whether certain tokenized gold products should be exempt from UK fund rules. The FCA and the Bank of England have said they plan to publish a roadmap for tokenization in wholesale financial markets later this year.

The regulator expects to consult on further changes to its perimeter guidance later this year.
